Holiday Let Agreement
3 Cresswell Court, Tenby. Last updated 3 November 2026
This agreement is a licence to occupy for a short holiday stay, not a tenancy.
1. The parties and the booking
1.1 This agreement is between Lloyd Jones and Paula Jones, trading as Fairwood Properties ("we", "us"), and the lead guest named in the booking confirmation ("you").
1.2 We agree to let you occupy 3 Cresswell Court, Cresswell Street, Tenby SA70 7HG ("the Apartment") for the dates in your booking confirmation, for a holiday stay only.
1.3 This is a licence to occupy, not a tenancy. You have no right to exclusive possession beyond the stay, and no right to stay on after the departure date.
1.4 The agreement is formed when we have received your payment in full and sent you a booking confirmation. Until then your dates are not secured and may be booked by others, including through Airbnb.
1.5 The booking confirmation sets out the arrival date, departure date, number of nights, number of guests and price. It forms part of this agreement.
1.6 A direct booking is a contract between you and us. It is not covered by Airbnb's guest protections or AirCover.
2. Payment, deposit, cancellation and refunds
2.1 Price and payment. The price is the total shown in your booking confirmation. It is paid in full by card through our secure Stripe link when we confirm your dates. Payment is made to Fairwood Properties.
2.2 Damage deposit. Where we consider it necessary, for example for a first-time guest, we may ask for a refundable damage deposit of £100. If we do, we will tell you before you arrive. We return it within 7 days of departure, less the cost of any damage or missing items, which we will itemise and evidence.
2.3 Cancellation by you. To cancel, reply to your confirmation email. Refunds are paid to the original card:
- 14 days or more before arrival: full refund.
- 7 to 13 days before arrival: 50% refund.
- fewer than 7 days before arrival, or a no-show: no refund.
2.4 Shortening your stay. If you leave early, or ask to shorten the stay, no refund is due unless we agree otherwise in writing.
2.5 If we cancel. If we have to cancel for a reason within our control, or because the Apartment is unavailable or unsafe, we will refund everything you have paid, and will try to offer a comparable stay if you want one.
2.6 Events outside anyone's control. Neither of us is liable for failing to perform because of events beyond reasonable control (severe weather, fire, flood, loss of utilities, government restrictions). If the Apartment cannot be used, we will refund the nights you cannot use. We cannot refund travel or other costs.
2.7 Travel insurance. We recommend you take out travel and cancellation insurance.
3. Who can stay, arrival, departure and house rules
3.1 Occupancy. The lead booker must be aged 25 or over and must stay throughout. The Apartment is not suitable for children or infants. The maximum overnight occupancy is 2 guests only. The property is licensed, insured and fire-risk assessed for no more than two overnight guests. No one may sleep in the lounge, kitchen or any non-bedroom area, and no additional overnight guests are permitted under any circumstances.
3.1A Visitors. Daytime visitors are welcome, provided that:
- visitors do not stay overnight;
- visitors leave quietly by 10:00 pm;
- the total number of people remains reasonable for a small residential flat; and
- visitors do not cause noise, disturbance or nuisance to neighbouring occupiers.
3.2 Access. The Apartment is on the first floor with its own staircase and may not suit anyone with limited mobility. It is your responsibility to check suitability before booking.
3.3 Arrival and departure. Arrival is on a Monday or a Friday from 3.00pm. Departure is on a Monday, Thursday or Friday strictly by 10.00am. Earlier check-in may be possible by agreement but cannot be guaranteed. If you do not leave by the check-out time we may charge for any resulting cost to us, such as a delayed changeover.
3.4 No pets. Pets are not allowed, other than assistance dogs, which we will happily welcome if you tell us in advance.
3.5 Smoking. No smoking or vaping anywhere in the Apartment or the building.
3.6 Noise, neighbours and gatherings. This is a residential building with close neighbours. Please keep noise to a minimum at all times. Quiet hours are 10.00pm to 8.00am. Please also be quiet at all times outside the front door, which is directly next to the bedroom window of Flat 1 below. The Apartment must not be used to host gatherings, meet-ups, parties or social events.
3.7 Parking. Your car must only be parked in the marked space allocated to Flat 3. Please do not park in any other space.
3.8 Use. The Apartment must be used only as holiday accommodation and only lawfully. You must not sub-let it or use it for business or commercial purposes without our written consent.
3.9 Other house rules. Our house rules, which we give you before arrival, form part of this agreement.
4. Care of the property, damage, liability and access
4.1 Care and leaving the Apartment. Please look after the Apartment and its contents, and tell us promptly about any damage or breakage, however it happened. We really appreciate it if the Apartment is left in a generally clean and tidy condition. Before you leave:
- remove food items from the fridge and either take them home or put them in the rubbish bag;
- if you can, remove the outer bedding only and place it in the blue IKEA bag; and
- do not remove the pillow and mattress protectors, as these are handled separately.
4.2 Damage. You are responsible for loss or damage to the Apartment and its contents caused by you or anyone you let in, other than fair wear and tear. We may deduct the reasonable cost of repair or replacement from the deposit, and claim any balance from you.
4.3 Keys and safety. You must keep the entrance secure, must not copy or lend keys or access codes, and must tell us at once if they are lost. You must follow the safety information in the Apartment, including for smoke and carbon monoxide alarms and fire escape. The Apartment has smoke detectors in the hall and bedroom, a heat detector in the kitchen, and a linked carbon monoxide alarm next to the boiler. We hold a current landlord's gas safety certificate and electrical installation condition report (EICR). Please do not cover, disable or tamper with any alarm.
4.4 Our access. We, or someone on our behalf, may enter the Apartment during your stay in an emergency, or for urgent repairs or safety checks, and otherwise only with your agreement and reasonable notice.
4.5 Faults. If something stops working, tell us and we will try to fix it quickly. We cannot guarantee uninterrupted utilities, heating, hot water or internet. If a problem is our responsibility and seriously affects your stay, we will discuss a fair remedy with you.
4.6 Our liability. Nothing in this agreement limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited, and it does not affect your rights under consumer law. Subject to that, we are not liable for loss or damage to your belongings, or for loss that was not a reasonably foreseeable result of our breach.
4.7 Your belongings and your guests. You are responsible for your own belongings and for the conduct of everyone you let into the Apartment. Please take out insurance for valuables.
4.8 Ending the stay early. Breach of the occupancy, visitor or noise rules in clauses 3.1, 3.1A and 3.6 is a material breach of this agreement and may result in immediate termination of the stay without refund. If more than two people stay overnight, the booking will be cancelled without refund. We may also end the stay without refund if you or your guests seriously or repeatedly breach any other term, or behave in a way that is unlawful or dangerous. You must then leave promptly.
5. Guest details, data, complaints, governing law and acceptance
5.1 Guest details. Before arrival you must give us, for every guest aged 16 or over, their full name and nationality, plus a contact telephone number and a home address for the lead guest. Guests who are not British, Irish or Commonwealth citizens must also give passport details and their next destination. We need this to meet legal record-keeping duties and to be able to contact you or pursue a claim if something goes wrong. We keep guest records for at least 12 months, and as described in our privacy notice.
5.2 Complaints. If anything is not right, tell us straight away, during your stay, so that we can put it right. You can also contact us afterwards at booking@cresswellcourt.co.uk, and we will reply within 3 working days.
5.3 Governing law. This agreement is governed by the law of England and Wales. The courts of England and Wales have jurisdiction.
5.4 Your statutory rights. Nothing in this agreement affects your rights under consumer law.
5.5 Changes and whole agreement. This agreement, with your booking confirmation and our house rules, is the whole agreement. A change must be agreed in writing, including by email.
5.6 Acceptance. By ticking the box on the booking form, and by paying, you confirm that you have read and agree to this agreement, on behalf of yourself and everyone in your party, and that the details you give are correct.
